The Residence Permit for Subordinate and Seasonal Work Reasons is the residence permit necessary for non-EU citizens who have entered Italy with a visa for Subordinate or Seasonal Work following the issuance of a nulla osta (clearance) for Subordinate or Seasonal Work.
The procedure involves requesting the kit (necessary for applying for the Residence Permit) from the Prefecture (specifically the Single Immigration Desk) within 8 days of the worker’s entry into the country.
The Residence Permit for Subordinate or Seasonal Work has a variable duration depending on the type of employment contract (fixed-term, permanent):
- From 6 to 9 months for the issuance of the first Residence Permit for Seasonal Work;
- 1 year for the issuance of the first Residence Permit for Subordinate Work in the case of a fixed-term contract lasting 1 year and less than 2 years;
- 2 years for the issuance of the first Residence Permit for Subordinate Work in the case of a fixed-term contract exceeding 2 years or for an indefinite period;
- From 1 to 2 years for the renewal of the Residence Permit for Subordinate Work, depending on the duration of the employment contract (fixed-term, indefinite).
Note: The Residence Permit for Seasonal Work cannot be renewed but can be converted.
The initial issuance of the Residence Permit for Subordinate or Seasonal Work: The foreign citizen must go to the Prefecture (Single Immigration Desk) competent for the territory within 8 days of entering Italy to finalize the entry procedure, sign the Integration Agreement, and request the issuance of the Residence Permit. After verifying the validity of the visa, the employment relationship, and the availability of suitable accommodation for the worker, the Prefecture provides pre-filled forms (kit) for the Residence Permit application, to be sent with a special envelope through authorized Post Offices.
The employer undertakes to activate the employment contract (UNILV/UNISOMM registration or activation of a domestic work contract with INPS) promptly.
The following must be attached to the application for the Residence Permit via postal kit:
- Model 209 – Module 1 duly completed;
- Model 209 – Module 2 duly completed;
- Photocopy of the passport or equivalent document valid (pages containing personal data, photograph, stamps, visas, and the work entry visa with the entry stamp);
- €16.00 revenue stamp.
Costs of the application: The contributions for adult foreigners are as follows:
- Receipt of payment of €30.46 for the issuance of the Residence Permit in electronic format (PSE) to be paid into postal current account no. 67422402 payable to the Ministry of Economy and Finance – Treasury Department with the reason for payment “amount for the issuance of the electronic Residence Permit”;
- Payment of €30.00 for postal kit shipping expenses (registered format);
- Contribution payment of €50.00 for the issuance of the Residence Permit for a duration exceeding one year and up to two years.
The receipt for the new contribution must be presented at the time of the appointment at the Questura for fingerprint acquisition.
If the issuance of the Residence Permit is requested using a single kit from Poste Italiane for the same family unit with parents and children under 14 years old, the receipt of payment of €30.46 must be attached for each member of the family unit.
The foreign citizen must submit the application at authorized Post Offices.
The Poste Italiane operator delivers to the foreign citizen the receipt of the registered mail which must be retained. Two personal identification codes (user ID and password) are printed on the receipt, which can be used to check the status of the procedure, the date of the fingerprint appointment, and the subsequent collection of the Residence Permit here.
The Questura takes the foreign citizen’s fingerprints and photographs.
At the fingerprint appointment, the employment contract initiated and the UNILAV/UNISOMM model or INPS receipt for Domestic Work must be provided.
With the Residence Permit for self-employment, it is possible to carry out, for the same period, subordinate activity without converting the permit itself. Upon renewal of the permit, a new permit will be issued for the type of activity actually performed.
If the foreign citizen is unemployed at the time of renewal, they can request a Residence Permit for Job Seeking via postal kit, attaching registration with the Employment Center. The Residence Permit for Job Seeking cannot be renewed but can be converted for work reasons.
